Message from the President

Happy Holidays!

 

It’s hard to believe we’re already wrapping up 2025 and looking ahead to 2026! As I reflect on this past year, I’m filled with gratitude not only for my family (that goes without saying) but also for all of you, our valued retail broker trading partners. Even more, for the awesome people that I have the opportunity to work with on this team. The people on this team inspire me, motivate me to always push towards perfection, ground me and make me laugh every single day! I am so fortunate to be part of something so special. So, on behalf of the entire RT ECP team, thank you for your business, support, and friendship. We wish you a joyful holiday season and a prosperous new year.

The fourth quarter has been a busy one for RT ECP. Our annual participation and sponsorship at the IRMI Construction Risk Conference was, as always, a tremendous success. It was great connecting with so many retail brokers and carriers all in one place. IRMI continues to be an excellent forum for keeping our team informed and engaged with the latest developments in the marketplace.

RT ECP Team Spreads Holiday Cheer

 

Our entire team spent a week together in the Hamilton, NJ office for some holiday cheer. We had our annual holiday party - this year at Seasons 52 - where we shared lots of laughs and created new memories.

 

In addition, we held our annual Adopt A Family for the holidays. For 12 years, our team has collaborated with St. Mary's Church in Bordentown, NJ to provide Christmas gifts to families in need. Our team once again stepped up with generosity and kindness, helping make the season brighter for those who might not otherwise have had one.

Farmers Face Growing Pollution Liability Risks

 

Farmers have long relied on fertilizers and pesticides to sustain their crops. This practice, however, comes with an increasing number of pollution liability risks. Our rivers and oceans are being polluted by agricultural runoff, creating significant environmental challenges for farmers. In his article "Farmers Face Growing Pollution Liability Risks," recently published on Insurance Thought Leadership, RT ECP's Jayden Johnson discusses these risks and explains how insurance solutions can help to mitigate exposures, protecting farmers from potentially costly claims. Risk Tip - Additional Insureds and Professional Liability – How naming your client as an AI can jeopardize coverage

It's common practice in the construction industry for owners to require the insured to name them as an additional insured on their general liability policies, so one would think that it would make sense to extend this requirement to your insured’s professional liability policy as well. But be careful! Providing owners with additional insured status under their professional liability policy can jeopardize the intended coverage for both parties. For example, insured versus insured exclusions in professional liability policies typically do

not include “carvebacks” for claims brought against the named insured by an additional insured. As a result, were an owner to be named as an additional insured on the insured’s policy, the insured versus insured exclusion would typically apply to any claims brought by that owner against the named insured for negligence in the provision of professional services, removing coverage for an exposure that the policy was originally intended to cover. Furthermore, a professional liability policy is designed to cover services provided by or on behalf of the named insured in their capacity as a licensed design professional; the entity requesting to be added as an additional insured is likely not held to the same standard of care as a licensed design professional and carriers may be unwilling to extend coverage to them as a result. So, while it may be typical in other lines for additional insured provisions to be reciprocated between your insured and their clients, this will likely not be the case on a professional liability policy. The owners may not even carry professional liability insurance, and if they carry this coverage, it is unlikely that they would be willing/able to name your client as an additional insured on their policy.
